evalban

Terms of Service

Last updated November 1, 2026

The short version

  • Evalban is in early access. It's free for now, may change, and comes without guarantees.
  • Your team owns what it puts in Evalban. We only use it to run the Service.
  • Use Evalban lawfully, keep your API keys secret, and don't abuse the Service.
  • If we introduce paid plans, we'll tell you at least 30 days before you're charged anything.
  • These summaries help you read the terms; the full text below is what applies.

1. The agreement

These Terms are an agreement between you and Evalban, operated by its founder as an individual based in Utah, United States ("Evalban", "we", "us"). They cover evalban.com, app.evalban.com, the Evalban APIs, SDKs and GitHub Action, and the waitlist (together, the "Service"). By joining the waitlist, creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

If you use Evalban for an organization, you agree on its behalf and confirm you're allowed to. "You" then means both you and that organization. You must be at least 16 to use Evalban.

2. Early access

Evalban is in early access. Features may change, be limited or be removed, and the Service may sometimes be unavailable. We may decide who gets access and may end the early-access program, with reasonable notice where we can. Please tell us what works and what doesn't. We may use your feedback freely, without owing you anything for it.

3. Accounts and workspaces

4. Your content

"Your content" is everything you or your team add to the Service: issues, comments, eval results, examples, feedback data and files. You keep all rights to it. You give us a limited license to host, copy, process and display your content only to provide, secure and support the Service for you, and as described in our Privacy Policy. We don't use your content to train AI models.

You're responsible for your content and for having the rights and permissions to send it to us, including any personal data in eval examples or production feedback. Don't send highly sensitive data, such as government ID numbers, payment card numbers or health records, unless we've agreed in writing that the Service can handle it.

You can export or delete your content by asking us. When a workspace is deleted, we delete its content as described in the Privacy Policy.

5. Acceptable use

Don't use Evalban to:

We may suspend access that breaks these rules or puts the Service or other customers at risk. Where we reasonably can, we'll tell you first and give you a chance to fix the problem.

6. Other services

Evalban can connect to services you choose, such as GitHub and Slack. Your use of those services is governed by their terms, and we aren't responsible for them. By connecting one, you allow us to exchange data with it to do what you asked.

7. Price

Evalban is free during early access. Prices on our website show our plans, but you won't be charged anything unless you agree to a paid plan. If we introduce paid plans, we'll tell you at least 30 days in advance, and you can stop using the Service before any charge applies.

8. Our property

The Service, including its software, design and the Evalban name and logo, belongs to us and our licensors. These Terms give you the right to use the Service, but no other rights to it. The SDKs and GitHub Action may come with their own license terms, which apply to that code.

9. No warranties

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that the Service will be uninterrupted, error-free or secure, that eval verdicts or automatically filed bugs will be accurate or complete, or that it will catch every regression. You remain responsible for decisions about releasing your software and models.

10. Limit of liability

To the fullest extent the law allows, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service or these Terms. Our total liability for all claims is limited to the greater of the amount you paid us for the Service in the 12 months before the claim and one hundred US dollars (US$100).

Some places don't allow these limits, so they may not fully apply to you. Nothing in these Terms limits liability that can't be limited by law.

11. Your responsibility to us

If someone makes a claim against us because of your content, or because you broke these Terms or the law, you'll cover our reasonable costs of dealing with it, including reasonable legal fees, to the extent the law allows.

12. Ending

You can stop using Evalban at any time and ask us to delete your account or workspace. We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering the Service. If we stop offering the Service, we'll give you at least 30 days' notice where we can, so you can export your content. Sections 4 (your responsibility for your content), 8, 9, 10, 11, 13 and 14 continue to apply after these Terms end.

13. Changes to these Terms

We may update these Terms as Evalban grows. For material changes, we'll tell account holders by email or in the app at least 14 days before they take effect, unless the change is needed sooner for legal or security reasons. If you keep using Evalban after changes take effect, you accept them.

14. Law and disputes

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law rules. Any dispute that can't be resolved informally will be decided in the state or federal courts located in Salt Lake County, Utah, and both sides agree to those courts' jurisdiction. Before going to court, please email us at [email protected] so we can try to resolve it. If you're a consumer, you keep any rights that the law where you live doesn't allow to be waived.

15. Everything else

These Terms and the Privacy Policy are the whole agreement between us about the Service. If a part of these Terms can't be enforced, the rest still applies. If we don't enforce a right right away, we haven't given it up. You can't transfer these Terms without our consent; we may transfer them as part of a merger, sale or transfer of the business. Neither of us is responsible for delays caused by events beyond reasonable control.
